1Acceptance of Terms Indian Contract Act 1872

By creating an account on CareerARIA, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These two documents together form the entire agreement between you and Nitpeak Technologies Private Limited regarding your use of CareerARIA.

If you do not agree to these terms, you may not create an account or use the service. By clicking "Create Account" on the signup form, you are accepting these terms on behalf of yourself as an individual.

Under the Indian Contract Act 1872, a valid contract can only be entered into by a person who has attained the age of majority. You must be at least 18 years of age to use CareerARIA. By agreeing to these terms you confirm that you meet this requirement. Accounts created by minors are void under Indian law and will be deleted upon discovery.

These terms constitute an electronic contract as recognised under the Information Technology Act 2000 and the Indian Contract Act 1872. Your electronic acceptance (by ticking the checkbox and creating an account) is legally binding.

2What CareerARIA Provides

CareerARIA is an AI-assisted career tool operated by Nitpeak Technologies Private Limited. It provides the following features:

  • Resume Analyzer: Scores your resume against a job description, identifies missing keywords, and suggests improvements.
  • Cover Letter Builder: Generates a tailored cover letter based on a job description and your resume.
  • LinkedIn Optimizer: Scores your LinkedIn profile text and suggests rewrites for key sections.
  • Company Intelligence: Provides background on a target company and how to position yourself for a role there.
  • Interview Prep: Generates role-specific interview questions and guidance for answering them.
  • ARIA Chat: A conversational AI assistant you can ask career-related questions, with context drawn from your saved content.

All features are powered by AI. Results are suggestions, not guarantees. See Section 6 (AI-Generated Results) for details.

3Your Account

Registration

You must provide a valid email address, a real name, and a password of at least 8 characters to create an account. You must verify your email address before you can log in. Each person may hold only one account.

Account Security

You are responsible for keeping your password confidential. Do not share your account credentials with anyone. If you suspect your account has been accessed without your permission, change your password immediately and contact us.

Accurate Information

You agree to provide accurate, current information when registering and to keep it updated. Creating an account with false identity information is a violation of these terms and may constitute an offence under the Information Technology Act 2000.

Account Deletion

You can permanently delete your account at any time from account settings. Deletion removes all your stored content, resumes, analyses, cover letters, and chat history from our systems. This action is irreversible.

4Acceptable Use IT Act 2000

CareerARIA is intended for personal, lawful use in connection with your own job search and career development. You agree not to:

  • Use the service to create content on behalf of others without their knowledge or consent
  • Submit content that belongs to another person (such as another person's resume) without their explicit permission
  • Attempt to circumvent or abuse the platform's usage quotas through automation, scripting, or the creation of multiple accounts
  • Use the service to generate content that is misleading, deceptive, or intended to misrepresent your qualifications to employers
  • Reverse-engineer, scrape, or extract data from the platform in any automated way
  • Attempt to access accounts, data, or systems other than your own
  • Use the service for any purpose that violates the Information Technology Act 2000, the Indian Penal Code, or any other applicable Indian law
  • Interfere with the operation of the platform, its servers, or any connected infrastructure
  • Upload or transmit any content that is obscene, defamatory, harassing, or unlawful under Indian law
Note on AI-assisted applications: CareerARIA is a tool to help you communicate your real qualifications more clearly. Using AI-generated content to misrepresent your experience or skills to employers may violate employer policies and applicable laws including the Indian Penal Code provisions on cheating and misrepresentation. You are solely responsible for the accuracy of any content you submit in a job application.

5Your Content

You retain full ownership of all content you submit to CareerARIA, including your resume, job descriptions, LinkedIn text, and chat messages. By submitting content, you grant Nitpeak Technologies Private Limited a limited, non-exclusive, royalty-free licence to process and store that content for the sole purpose of delivering the service to you.

This licence is revocable at any time by deleting the relevant content or your account. We do not claim any ownership over your content. We do not share it with other users. We do not use it to train AI models.

You are responsible for ensuring that content you submit does not violate the rights of any third party, including copyright, privacy, or confidentiality rights, and does not violate any Indian law.

6AI-Generated Results

CareerARIA uses the Google Gemini API to generate analysis results, suggestions, cover letters, interview questions, and chat responses. All output produced by the platform is AI-generated and should be treated as a starting point, not a definitive answer.

  • ATS scores and keyword analysis are estimates, not guarantees of how a real ATS system will rank your resume.
  • Cover letters and rewrite suggestions are AI drafts that you should review and edit before use.
  • Company intelligence is based on general AI knowledge and may not reflect the most current information about a specific company.
  • Interview questions and answers are practice aids. Real interviews may differ significantly.
  • ARIA Chat responses are informational only and do not constitute professional career, legal, or financial advice.

Nitpeak Technologies Private Limited makes no guarantee that using CareerARIA will result in interviews, job offers, or any specific career outcome. All decisions about your job search and career remain yours.

7Plans and Billing Consumer Protection Act 2019

Free Plan

A Free plan is available with no payment required. Free plan usage is limited per month across all modules. These limits may be adjusted by Nitpeak Technologies Private Limited at any time with reasonable notice to existing users.

Paid Plans

Paid plans (Starter, Pro, Unlimited) are billed on a monthly basis. Pricing is displayed on the pricing page before purchase and may vary by region. By subscribing to a paid plan, you authorise Nitpeak Technologies Private Limited to charge your chosen payment method on a recurring monthly basis.

All prices are inclusive of applicable taxes unless otherwise stated. In accordance with the Consumer Protection Act 2019, the price displayed at the time of purchase is the price you will be charged.

Cancellation and Refunds

You may cancel or downgrade your plan at any time from account settings. Cancellation takes effect at the end of the current billing period. You retain access to paid plan features until that date.

We do not offer refunds for partial billing periods. If you believe you have been incorrectly charged, contact us at support@nitpeak.com within 7 days of the charge and we will investigate.

Changes to Pricing

We may update pricing for paid plans. We will provide at least 14 days written notice (by email) before any price change takes effect for existing subscribers.

Payment Not Yet Active

As of the effective date of these terms, payment processing has not been implemented. Paid plan upgrades will be activated manually or through a payment integration added in a future update. This section will apply fully when billing becomes active.

8Suspension and Termination

Nitpeak Technologies Private Limited reserves the right to suspend or terminate your account at any time if:

  • You violate any provision of these Terms of Service
  • You attempt to circumvent usage limits, access controls, or security measures
  • Your account is associated with abusive, fraudulent, or illegal activity under Indian law
  • You create multiple accounts to bypass Free plan limits
  • We are required to do so by a court order or competent authority under Indian law

Where reasonably possible, we will notify you of a suspension and the reason for it before taking action. In cases of serious violation or legal requirement, immediate action may be taken without prior notice.

Suspended accounts retain their data for 30 days, after which the account and all associated content may be permanently deleted.

You may also terminate your own account at any time by using the account deletion feature in settings. Upon deletion, all your data is removed immediately and permanently.

9Intellectual Property Copyright Act 1957

CareerARIA, its codebase, design, branding, and all platform-generated UI elements are the intellectual property of Nitpeak Technologies Private Limited and are protected under the Copyright Act 1957 and applicable Indian intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without written permission.

The AI-generated output produced in response to your specific inputs (cover letters, rewrites, analysis results) is delivered to you for your personal use. You may use, edit, and submit this output as you see fit, subject to the acceptable use requirements in Section 4.

The CareerARIA name, the "◈" logo mark, and Panda Tech Bytes branding are not licensed for use outside of ordinary attribution in using the service.

10Disclaimers

CareerARIA is provided "as is" and "as available" without warranties of any kind, either express or implied, to the maximum extent permitted by Indian law. Nitpeak Technologies Private Limited does not warrant that:

  • The service will be uninterrupted, error-free, or available at all times
  • AI-generated results will be accurate, complete, or suitable for any particular purpose
  • Using the service will result in improved job application outcomes
  • The service will be free of bugs, security vulnerabilities, or other technical issues

You use CareerARIA at your own discretion and risk. The service is a productivity aid, not a guarantee of career outcomes.

11Limitation of Liability

To the maximum extent permitted by applicable Indian law, Nitpeak Technologies Private Limited and its operators will not be liable for any indirect, incidental, special, or consequential damages arising from your use of CareerARIA, including but not limited to:

  • Loss of employment opportunities or adverse career outcomes
  • Decisions made based on AI-generated content from the platform
  • Data loss due to account deletion, technical failure, or force majeure events
  • Unauthorised access to your account due to your failure to secure your credentials

In any case, our total aggregate liability to you for any claim arising from use of the service will not exceed the total amount you paid to CareerARIA in the 3 months preceding the event giving rise to the claim. For free-plan users, our liability is limited to INR 1,000.

Nothing in these terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under Indian law.

12Consumer Rights Consumer Protection Act 2019

If you are a consumer as defined under the Consumer Protection Act 2019 (i.e., you use CareerARIA for personal purposes and not for commercial resale), you have the following rights which these terms do not limit:

  • Right to information: You are entitled to know the nature, quantity, and terms of the service before subscribing to any paid plan. All plan details are displayed on the pricing page before purchase.
  • Right against unfair trade practices: We will not engage in false advertising, misleading descriptions, or any deceptive practice in connection with our service.
  • Right to seek redressal: If you have a complaint about the service, you may contact our Grievance Officer (see our Privacy Policy, Section 15). If unresolved, you may approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act 2019.
  • Right to a fair contract: No clause in these terms is intended to be an unfair contract term. If any court or competent authority finds a term to be unfair or void under the Consumer Protection Act 2019, only that term is severed; the rest of these terms remain in force.

13Governing Law and Disputes Indian Contract Act 1872 IT Act 2000

Governing Law

These Terms of Service and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act 1872, the Information Technology Act 2000, and the Consumer Protection Act 2019.

Jurisdiction

Subject to the dispute resolution process below, you agree that any legal action or proceeding arising out of or relating to these terms or your use of CareerARIA shall be brought exclusively in the courts of Pune, Maharashtra, India, and you consent to the personal jurisdiction of those courts.

Dispute Resolution

Before initiating any legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at support@nitpeak.com. We will attempt in good faith to resolve the dispute within 30 days.

If the dispute is not resolved informally, either party may refer it to arbitration in accordance with the Arbitration and Conciliation Act 1996. The arbitration shall be conducted in English, in Pune, Maharashtra. The arbitral award shall be final and binding on both parties.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

14Changes to These Terms

We may update these Terms of Service as the product evolves or as applicable Indian laws are amended. When we make material changes, we will update the effective date at the top of this page and notify you via email or an in-app notice.

For material changes that affect your rights or obligations, we will provide at least 14 days notice before the changes take effect. Continued use of CareerARIA after the notice period constitutes acceptance of the revised terms.

If you do not agree to the updated terms, you should stop using the service and delete your account before the effective date of the changes.

15Media Partner

Nitpeak Technologies Private Limited has engaged Panda Tech Bytes as its official media and marketing partner for CareerARIA. Panda Tech Bytes handles promotional content, social media campaigns, and related marketing activities on behalf of CareerARIA.

Panda Tech Bytes operates independently as a media channel and is not a party to these Terms of Service. It does not have access to your personal data, payment details, or account information, and is not liable for the platform, its features, pricing, or any obligations arising from your use of CareerARIA.

Any content published by Panda Tech Bytes about CareerARIA (including promotional videos, posts, or reviews) is marketing material and not a contractual representation. Your agreement is solely with Nitpeak Technologies Private Limited.
